Appeals court upholds life sentence in drug case

FARGO, N.D. (AP) — A federal appeals court has upheld the life sentence of a man convicted in a North Dakota drug case.

Raul Tovar was found guilty last year of conspiracy to possess methamphetamine with intent to distribute, and aiding and abetting. Authorities say he was dealing drugs in the Fargo and Moorhead, Minnesota, area.

Tovar argued to the 8th U.S. Circuit Court of Appeals that a judge made a mistake when he gave instructions to the jury on the aiding and abetting charge after his lawyer's closing arguments.

The appeals court says the judge did not prejudice the case because the instructions were given before jury deliberations.
